Tout en reconnaissant les difficult\u00e9s rencontr\u00e9es par les victimes dans leur tentative pour obtenir justice, la Cour d\u2019appel a statu\u00e9 que le Qu\u00e9bec ne disposait pas de la l\u00e9gislation n\u00e9cessaire pour entendre leur cause.<\/p>\n<p>La soci\u00e9t\u00e9 canadienne Anvil Mining est accus\u00e9e d\u2019avoir fourni du soutien logistique \u00e0 l\u2019arm\u00e9e congolaise qui, en 2004, a viol\u00e9, tu\u00e9 et brutalis\u00e9 les habitants de Kilwa en RD Congo. Selon les Nations Unies, on estime \u00e0 100 le nombre de civils d\u00e9c\u00e9d\u00e9s au cours de cette op\u00e9ration militaire, dont certains ont \u00e9t\u00e9 ex\u00e9cut\u00e9s et jet\u00e9s dans des fosses communes.<\/p>\n<p>L\u2019ACCI, une coalition d\u2019ONG repr\u00e9sentant les proches des victimes du massacre de Kilwa, avait d\u00e9pos\u00e9 un recours collectif en 2010 contre Anvil Mining Limited pour son r\u00f4le pr\u00e9sum\u00e9 dans le massacre. Anvil Mining nie toute action r\u00e9pr\u00e9hensible.<\/p>\n<p>Dans le jugement rendu la semaine derni\u00e8re, les juges Forget, Wagner et Giroux de la Cour d&#8217;appel du Qu\u00e9bec, ont d\u00e9clar\u00e9 que les liens avec le Qu\u00e9bec \u00e9taient insuffisants parce que le bureau d&#8217;Anvil Mining situ\u00e9 \u00e0 Montr\u00e9al n&#8217;avait pas \u00e9t\u00e9 impliqu\u00e9 dans les d\u00e9cisions menant \u00e0 son r\u00f4le pr\u00e9sum\u00e9 dans le massacre. While acknowledging the difficulties that the victims have encountered in their attempt to obtain justice, the appeal Court ruled that they lack the necessary legislation to allow the case to proceed in Quebec.<\/p>\n<p>Anvil Mining, a Canadian corporation, is accused of providing logistical support to the Congolese army who raped, murdered and brutalised the people of Kilwa in the DRC. According to the United Nations, an estimated 100 civilians died as a direct result of the military action, including some who were executed and thrown in mass graves.<\/p>\n<p>The CAAI, an NGO coalition representing relatives of victims of the 2004 Kilwa massacre, filed a class action in 2010 against Anvil Mining for its alleged role in the massacre. Anvil Mining denies any wrongdoing.<\/p>\n<p>In the ruling last week, Justices Forget, Wagner and Giroux of the Quebec Court of Appeal, stated that there was insufficient connections to Quebec because Anvil Mining\u2019s Montreal office was not involved in decisions leading to its alleged role in the massacre.
